These Terms of Service (“Terms”) govern your access to and use of the MyCardky platform, website, applications, and related services (collectively, the “Services”).
 
MyCardky is operated by SenseRealtor, a company registered in Ontario, Canada.
 
By creating an account, accessing, or using the Services, you agree to be bound by these Terms.
 
If you do not agree to these Terms, you must not use the Services.
 
1. Eligibility
 
You must be at least 13 years old to use MyCardky.
By using the Services, you represent and warrant that:

• You have the legal capacity to enter into these Terms.

• The information you provide is accurate.

• You will comply with applicable laws and regulations.
   

2. Account Registration
 
To access certain features, you may be required to create an account.
You are responsible for:

• Maintaining the confidentiality of your account credentials.

• All activities that occur under your account.

• Providing accurate and up-to-date information.

You must notify us immediately if you believe your account has been compromised.
 
3. Description of Services
 
MyCardky provides digital profile and networking tools, including but not limited to:

• Digital business cards

• Public profile pages

• Contact sharing

• Social media links

• QR codes

• Schedule sharing

• Moments posts and content publishing

• Downloadable vCards

• Premium subscription features
   

We may modify, update, suspend, or discontinue any feature at any time.
 
4. User Content
 
You retain ownership of content that you upload or publish through MyCardky, including:

• Images

• Text

• Contact information

• Social media links

• Business information

• Moments posts
   

By publishing content through the Services, you grant MyCardky a non-exclusive, worldwide, royalty-free license to host, store, display, process, and distribute such content solely for the purpose of operating the Services.
You are solely responsible for the content you publish.
 
5. Prohibited Activities
 
You agree not to:

• Violate any law or regulation.

• Impersonate another individual or organization.

• Upload malicious software or harmful code.

• Use the Services for fraud, spam, phishing, or deceptive practices.

• Infringe intellectual property rights.

• Harass, abuse, or threaten others.

• Publish illegal, offensive, or harmful content.

• Attempt to gain unauthorized access to the platform or other user accounts.
   

We reserve the right to remove content or suspend accounts that violate these Terms.
 
6. Public Profiles
 
MyCardky allows users to create publicly accessible profile pages.
You acknowledge that information you choose to publish may be viewed by the public and indexed by search engines.
You are responsible for determining what information you make publicly available.
 
7. Subscription Plans
 
Certain features may require a paid subscription.
Subscription plans may include:

• Pro

• Max

• Ultra

or other plans introduced in the future.
Pricing and available features are displayed on our website and may change from time to time.
Changes will not affect active billing periods already paid for.
 
8. Billing and Payments
Payments are processed by Stripe or other authorized payment providers.
 
By purchasing a subscription, you authorize recurring billing according to the selected subscription plan.
You are responsible for:

• Maintaining valid payment information.

• Any taxes applicable to your purchase.
   

Failure to complete payment may result in suspension or termination of premium features.
 
9. Cancellation
 
You may cancel your subscription at any time.
Cancellation will prevent future renewal charges.
Unless otherwise required by law, cancellation does not automatically entitle you to a refund for payments already processed.

10. Intellectual Property
 
The MyCardky platform, software, design, branding, logos, and related materials are owned by MyCardky and/or SenseRealtor.
Except as expressly permitted, you may not:

• Copy

• Modify

• Reverse engineer

• Distribute

• Reproduce

any part of the Services without written permission.
 
11. Service Availability
 
We strive to provide reliable service but do not guarantee uninterrupted availability.
The Services may be unavailable due to:

• Maintenance

• Technical issues

• Security incidents

• Third-party service failures
   

We are not liable for temporary interruptions.
 
12. Termination
 
We may suspend or terminate your account if:

• You violate these Terms.

• We believe your use poses a security risk.

• Required by law.

• Fraudulent or abusive activity is detected.
   

Upon termination, access to certain Services may be removed.
 
13. Disclaimer of Warranties
 
The Services are provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, MyCardky disclaims all warranties, whether express or implied, including:

• Merchantability

• Fitness for a particular purpose

• Non-infringement
   

We do not guarantee that the Services will be error-free or uninterrupted.
 
14. Limitation of Liability
 
To the maximum extent permitted by law, MyCardky, SenseRealtor, and their affiliates shall not be liable for:

• Indirect damages

• Incidental damages

• Consequential damages

• Lost profits

• Loss of data
   

arising from the use of the Services.
15. Governing Law
 
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
 
Any disputes arising from these Terms shall be subject to the courts located in Ontario, Canada.

16. Changes to These Terms

We may update these Terms from time to time.
Updated versions will be posted on this page with a revised “Last Updated” date.
Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
